These terms govern your access to and use of kemRx's digital sourcing platform. Please read them carefully before accessing our services.
1. Acceptance of Terms
By accessing, registering for, or using the kemRx platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use the Service.
2. Eligibility & Verification
The Service is available only to qualified business entities and licensed professionals operating within the pharmaceutical compounding sector.
Licensure Requirement
You must hold a valid pharmacy license (503A or 503B facility) or be an authorized representative of a licensed pharmaceutical entity.
Verification Process
kemRx reserves the right to verify your credentials and may request documentation including state licenses and DEA registration.
3. Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.
4. Sourcing & Transactions
All transactions facilitated through kemRx are subject to supplier availability and compliance verification. kemRx acts as a platform facilitator and does not directly manufacture APIs or excipients.
- Orders are subject to final approval by the supplying manufacturer.
- Prices and availability are subject to change without notice.
- Documentation (COAs, SDSs, etc.) is provided as-is from verified suppliers.
5. Intellectual Property
All content on the kemRx platform, including but not limited to text, graphics, logos, and software, is the property of kemRx or its licensors and is protected by copyright, trademark, and other intellectual property laws.
6. Termination
We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in New York, NY.
